These Terms and Conditions govern your use of motivationresearch.org, the Center for Motivation Research website, our research and education resources, publications, essays, articles, contact forms, enquiry pathways, collaboration pathways, partnership enquiries, digital materials, online events, live sessions, programs, related websites, communications, support and related services operated by Center for Motivation Research Inc.
In these Terms, “we”, “us” and “our” means Center for Motivation Research Inc, an Australian incorporated non-profit organisation, ABN 84 109 838 718.
By accessing or using our website, reading or downloading our materials, submitting a form, making an enquiry, registering for an event, participating in a program, requesting collaboration, entering a partnership discussion, accessing a related website, subscribing to updates, purchasing or receiving digital access, or otherwise using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use our website, submit forms, access restricted materials, participate in events or programs, purchase or access resources, or use our services.
1. Definitions
In these Terms:
“Center” means Center for Motivation Research Inc, ABN 84 109 838 718.
“Content” means all text, images, graphics, logos, diagrams, research notes, essays, articles, audio, video, written materials, publications, digital products, frameworks, prompts, worksheets, downloads, recordings, replays, livestreams, design elements, software, branding and other material made available through the Website or Services.
“Digital Products” means any online material, downloadable resource, PDF, workbook, essay collection, recording, replay, prompt, worksheet, private access page, course resource, member resource or other digital content made available by us.
“Network Websites” means websites, landing pages, member portals, project pages or digital properties operated by us or connected with our work, including motivationresearch.org, aqmeets.com, leadershipcounselling.com, self-actualization.com, ilifechange.com, ileadershipforum.com, ireawaken.com, deinception.com and related subdomains or access pages.
“Programs” means any event, course, membership, educational program, leadership program, research pathway, live session, digital program, online challenge, masterclass, counselling-related service, forum, workshop, webinar, film-related event, or related offering operated by us.
“Publications” means research essays, field notes, articles, white papers, reports, media releases, case studies, presentations, commentary, frameworks, diagrams and other written or recorded materials published by us.
“Services” means the Website, Content, Publications, Digital Products, Programs, Network Websites, events, forms, research enquiries, educational resources, partnership pathways, contact pathways, communications, support and related services.
“Website” means motivationresearch.org and any page, subdomain, access page, landing page, form, checkout page, publication page or digital property operated by us in connection with Center for Motivation Research Inc.
2. Acceptance of these Terms
You agree to these Terms by:
- accessing or using the Website;
- reading, viewing, downloading or sharing our Content, Publications or Digital Products;
- submitting a contact form, research enquiry, collaboration enquiry, partnership enquiry, media enquiry, support request or feedback form;
- registering for, purchasing, receiving or participating in a Program, event, course, membership, forum, masterclass, call, online session or related service;
- using or accessing any Network Website;
- participating in research-related, educational, partnership, media, collaboration or project activity with us;
- making a payment, donation, grant, sponsorship, contribution or purchase through or in connection with the Services;
- subscribing to updates, newsletters, announcements or campaign communications; or
- otherwise interacting with us or our Services.
If you use the Services on behalf of an organisation, company, school, church, community group, institution, partnership, association, trust, foundation, agency, consultancy or other entity, you represent that you have authority to bind that entity to these Terms.
3. Changes to these Terms
We may update these Terms from time to time. The updated Terms will apply from the date they are published on the Website, unless otherwise stated.
Your continued use of the Website or Services after updated Terms are published means you accept the updated Terms.
Where reasonably practicable, we may notify users of material changes. It remains your responsibility to review these Terms periodically.
Changes to these Terms do not reduce any non-excludable rights you have under Australian Consumer Law or other applicable law.
4. Nature of the organisation
Center for Motivation Research Inc is a non-profit research and education organisation concerned with motivation, meaning, will, feedback, leadership formation, self-actualization, meaningful execution, and the practical question of why people often know the good they should do before they actually do it.
Our work may include research, writing, education, digital programs, leadership resources, public essays, private programs, field pathways, educational media, documentary projects, leadership counselling pathways, execution programs, self-actualization pathways, events, partnerships, collaborations and related activities.
Unless expressly stated otherwise, the Services are provided for educational, reflective, formative, research, leadership development, philosophical, motivational, strategic and general informational purposes.
Nothing on the Website should be interpreted as a promise that the Center is a university, accredited higher education provider, registered training organisation, clinical provider, financial adviser, legal practice, medical provider, charity with deductible gift recipient status, or government body, unless expressly stated in writing.
5. Network websites, projects and related services
The Center may operate or support multiple Network Websites, projects, brands, programs and public pathways connected with our research and education work.
These may include AQMeets, Leadership Counselling, Self-Actualization Quest Counselling, iLifeChange, MetaMotivations, iLeadership Forum, iReawaken, DeINCEPTION, partner portals, member portals, research pages, publication pages, contact pages, event pages and related websites.
Separate terms, privacy policies, checkout conditions, refund terms, membership terms, event terms, counselling terms, course terms, film terms, licence terms or participation terms may apply to specific Network Websites, Programs, purchases, events, memberships, services or projects.
If specific terms apply to a particular Network Website, Program, purchase, event, membership, service or project, those specific terms apply to that service to the extent of any inconsistency with these general Terms, unless doing so would reduce a non-excludable legal right.
6. Website access and public content
The Website may include public pages, research essays, articles, project pages, videos, images, diagrams, publications, contact forms, enquiry pathways, partnership pages, event pages, program pages, donation or support pathways, and other digital resources.
We may change, update, remove, replace, archive, restrict, rename, restructure or discontinue any page, article, resource, publication, project, form, link, feature, Program, pathway or Service where reasonably necessary.
We do not guarantee that the Website or any Content will remain available indefinitely, remain unchanged, be error-free, be current at all times, or meet your particular expectations or needs.
You are responsible for ensuring that your device, browser, internet connection, email account, payment method, calendar, software and technology environment are suitable for accessing the Website and Services.
7. Research, education and publication material
Our research, essays, articles, frameworks, field notes, publications, diagrams, videos, interviews and educational materials are intended to contribute to public understanding, reflection, formation and discussion.
Publications may be exploratory, developmental, philosophical, theoretical, educational, interpretive or applied. They may draw on research literature, field experience, counselling practice, leadership education, motivational theory, personal observation, interviews, historical sources, philosophical traditions, public sources, program experience or ongoing inquiry.
Unless expressly stated otherwise, our publications are not peer-reviewed academic journal articles, clinical guidelines, professional standards, government advice, medical guidelines, financial advice, legal advice, psychological treatment, or formal academic instruction.
We may revise, expand, correct, replace, archive or withdraw publications where we consider it appropriate.
You should not rely on any publication as the sole basis for a significant personal, legal, medical, financial, business, employment, organisational, spiritual, relational or professional decision.
8. No professional advice
Our Content and Services are not medical, psychological, psychiatric, counselling, therapeutic, legal, financial, taxation, investment, accounting, employment, crisis or emergency advice.
Unless expressly agreed in writing, the Services are not a substitute for professional diagnosis, clinical treatment, psychotherapy, psychiatric care, legal advice, financial advice, accounting advice, taxation advice, workplace investigation, human resources advice, counselling, therapy, business valuation, investment advice, or emergency assistance.
Although our Services may discuss motivation, happiness, meaning, leadership, execution, business rhythm, self-actualization, drift, will, reason, imagination, awareness, responsibility, habits, faith, philosophy, desire, strategy, decision-making, suffering, formation or moral life, we do not promise or guarantee any particular emotional, psychological, spiritual, financial, relational, educational, organisational, behavioural, leadership, productivity, income, business, revenue, profit, health or commercial outcome.
You should seek appropriate professional advice before making decisions that may have significant legal, financial, medical, employment, organisational, taxation, accounting, business, relational, spiritual, physical or personal consequences.
9. No emergency or crisis service
Our Services are not an emergency, crisis, suicide prevention, domestic violence, medical, psychiatric or urgent mental health service.
We do not monitor enquiries, emails, forms, support messages, research enquiries, partner messages, event chats, community messages or platform messages continuously and cannot guarantee an immediate response.
If you are experiencing a medical emergency, mental health crisis, risk of harm to yourself or another person, severe distress, violence, abuse or urgent personal difficulty, you should contact emergency services or an appropriate qualified professional in your location immediately.
In Australia, emergency assistance can be obtained by calling 000.
10. Programs, events, courses and member services
The Center may offer Programs, events, memberships, courses, forums, masterclasses, online challenges, documentary events, counselling-related pathways, leadership pathways, self-actualization pathways, research briefings, training resources, private sessions, public sessions, paid services, free resources and related services.
Program details, inclusions, exclusions, delivery format, access period, fees, refund terms, cancellation terms, schedule, live-session availability, replay availability, bonuses, support level, community access and technology requirements may be stated on the relevant offer page, checkout page, registration page, written proposal, confirmation email or specific terms.
We may change, reschedule, postpone, cancel, replace, rename, restructure, extend, shorten, pre-record, archive or otherwise alter a Program, event, topic, session, resource, replay, facilitator, access period or delivery format where reasonably necessary.
We will take reasonable steps to communicate material changes to registrants where practicable, but we are not responsible for notices you miss because of incorrect details, spam filters, email settings, calendar settings, platform issues, device issues, time zone errors or failure to check your inbox.
11. Bookings, calls and consultations
Some Services may involve bookings, calls, virtual meetings, discovery conversations, partnership discussions, research conversations, counselling-related enquiries, project discussions, advisory conversations, onboarding calls, media calls or consultations.
Bookings are subject to availability, confirmation, scheduling requirements, cancellation terms, rescheduling terms and any specific conditions stated at the time of booking.
We may decline, cancel, reschedule, restrict or discontinue a booking if we reasonably believe the booking is unsuitable, outside scope, unsafe, unlawful, abusive, misleading, commercially inappropriate, duplicative, or inconsistent with our purposes or these Terms.
Unless expressly agreed in writing, a booking or call does not create a client relationship, counselling relationship, advisory relationship, employment relationship, partnership, joint venture, fiduciary relationship, agency relationship or obligation to proceed with any project.
12. Research collaborations, partnerships and proposals
We may receive enquiries about research collaborations, interviews, partnerships, media, sponsorships, programs, institutional relationships, speaking, publication, events, licensing, joint projects, grants, donations or other proposals.
Submitting a proposal, enquiry, idea, document, pitch, request, application, partnership form, grant proposal or collaboration request does not require us to respond, accept, review, keep confidential, compensate you, proceed with a relationship, or enter into any agreement.
We may decline, archive, ignore, redirect, review, discuss, preserve, de-identify, aggregate or respond to proposals at our discretion.
Do not submit confidential, commercially sensitive, proprietary, trade secret, unpublished, third-party, client, employee, legal, financial or sensitive personal information unless we have expressly agreed in writing to receive it under appropriate confidentiality terms.
No partnership, collaboration, licence, grant, sponsorship, agency, employment, contractor, research, advisory, fiduciary or joint venture relationship is formed unless we enter into a separate written agreement signed or expressly approved by us.
13. Donations, grants, sponsorship and support
We may accept or invite donations, grants, sponsorships, contributions, patron support, project support, payments, purchases, gifts, partnership funding or other forms of support.
Unless expressly stated otherwise in writing, a donation, grant, sponsorship, purchase, contribution or payment does not give you ownership, control, approval rights, editorial rights, research control, publication rights, governance rights, intellectual property rights, decision-making authority, employment rights, partnership rights, or guaranteed access to any Program or Service.
Unless a receipt or written statement expressly says otherwise, payments made to us should not be assumed to be tax-deductible donations. You are responsible for obtaining your own taxation, accounting or legal advice about any payment, donation, grant, sponsorship or contribution.
We may refuse, return, redirect or decline support where we consider it inappropriate, unlawful, inconsistent with our purposes, reputationally risky, subject to unacceptable conditions, or otherwise unsuitable.
14. Digital access and materials
When you register for, purchase, receive or access Digital Products, publications, downloads, recordings, replays, written materials, course materials, event materials, private access pages, workbooks, essays, templates, diagrams, prompts or other resources, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use those materials for your own permitted use only, subject to these Terms and any specific terms that apply.
This licence does not transfer ownership of any Content, Digital Product, recording, workbook, exercise, prompt, research note, publication, diagram, idea, method, framework, program structure, design, brand or intellectual property right to you.
Unless expressly authorised by us in writing, you must not copy, download, rip, record, reproduce, duplicate, broadcast, livestream, transmit, publish, upload, distribute, share, sell, resell, sublicense, rent, lend, transfer, white-label, train from, scrape, commercialise or otherwise exploit the Services or Content.
15. Prices, payments, subscriptions and taxes
Prices, fees, Program fees, membership fees, subscription fees, digital product fees, course fees, event fees, consulting fees, counselling-related fees, licence fees, sponsorship amounts, donation pathways and payment terms may be displayed on a pricing page, checkout page, offer page, invoice, written proposal, confirmation page or order confirmation before payment is completed.
You are responsible for reviewing the price, currency, billing interval, renewal terms, access period, inclusions, exclusions, cancellation terms, refund terms, taxes and purchase terms before completing payment or confirming an engagement.
Payments may be processed by third-party payment providers. We do not control all aspects of third-party payment processing and are not responsible for delays, errors, declines, fees, exchange rates, card issues, bank issues, chargebacks, failed authentication, blocked payments or other issues caused by your bank, card issuer, payment provider or third-party platform, except where required by law.
If a Service is sold as a subscription or recurring payment arrangement, you authorise us and our payment processor to charge the payment method you provide for the recurring fee, renewal, upgrade, purchase, invoice, tax, fee or other amount due under the relevant offer terms until cancelled according to those terms.
You are responsible for keeping your billing information current and for any applicable taxes, duties, currency conversion fees, bank fees, card fees or other charges that may apply.
16. Refunds, cancellations and Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy, warranty, condition or other right that cannot lawfully be excluded, restricted or modified.
Where a satisfaction guarantee, refund guarantee, trial guarantee, cancellation promise or access promise is expressly stated on the relevant offer page, checkout page, written proposal, pricing page, order confirmation or specific terms, that guarantee applies only according to the terms, dates, requirements, access conditions and limitations stated for that offer.
To the extent permitted by law, and except where an express written guarantee applies, we do not offer refunds for change of mind, failure to attend live sessions, failure to watch replays during an access period, failure to use digital materials, failure to complete a Program, failure to cancel before renewal, lack of time, changed circumstances, dissatisfaction where the Service has been supplied as described and is not faulty, or because you did not achieve a desired result.
If a Service is faulty, not supplied as described, inaccessible due to an issue within our reasonable control, not provided with reasonable care and skill, not fit for a stated purpose where applicable, not supplied within a reasonable time where no time is agreed, or otherwise fails to meet a consumer guarantee, you may be entitled to a remedy under Australian Consumer Law.
If you experience a technical access issue, you should contact us within a reasonable time and provide sufficient details for us to investigate, including the details used to register or purchase, date of registration or purchase, relevant Service, device/browser used, screenshots where appropriate, and a description of the issue.
Where permitted by law, our liability for a failure to comply with a consumer guarantee may be limited to resupplying the relevant service or paying the cost of resupplying the relevant service.
17. User submissions and enquiries
If you submit information, ideas, proposals, messages, enquiries, testimonials, feedback, research questions, collaboration ideas, partnership proposals, media requests, project context, business context, personal context, comments, documents, files or other material to us, you warrant that:
- you have the right to submit that material;
- the material is accurate to the best of your knowledge;
- the material does not infringe any third-party rights;
- the material does not contain confidential information you are not authorised to share;
- the material is not unlawful, defamatory, misleading, offensive, obscene, threatening, discriminatory, commercially deceptive or otherwise inappropriate; and
- you are not submitting the material for an unlawful, unauthorised or harmful purpose.
You grant us permission to use, store, review, copy, respond to, moderate, publish, display, quote, paraphrase, refer to, de-identify, aggregate, internally share and otherwise process your submission for the purpose of assessing, responding to, administering, supporting, improving, delivering or acting on your enquiry, project, proposal, Program, research interest, Service access or relationship with us.
Submitting an idea, proposal, document, reflection, testimonial, comment, question or enquiry does not give you any ownership right, payment right, approval right, confidentiality right, partnership right or claim over any existing or future work, project, publication, product, course, campaign, event, feature, framework, research, service or business activity of ours.
18. Research participation and contributed information
From time to time, we may invite people to contribute information, interviews, responses, reflections, case material, feedback, survey responses, field observations or other material connected with research, education, publication or program development.
Unless a separate written research consent form, participant information statement, ethics protocol, confidentiality agreement or written agreement applies, any contribution you provide through ordinary website forms, email, event chats, interviews, public comments, informal calls, surveys, member spaces or general enquiries may be used, stored, reviewed, de-identified, aggregated, analysed or internally considered for our research, education, service improvement, publication planning or program development purposes.
We will take reasonable steps not to publish identifying personal information without appropriate permission, but you should not submit confidential, sensitive, client, employee, medical, legal, financial, trade secret or third-party information unless you have the right to do so and are comfortable with how it may be handled under these Terms and our Privacy Policy.
Participation in any research-related activity is voluntary unless expressly stated otherwise in a separate written agreement. We may decline, pause, discontinue, anonymise, de-identify, archive or remove research participation material where we consider it appropriate.
19. Confidentiality and sensitive information
Our work may involve discussion of motivation, leadership, responsibility, work, business, calling, relationships, self-actualization, execution, faith, meaning, suffering, decision-making, drift, discipline, personal formation or organisational life.
You are responsible for deciding what information you submit and where you submit it. You should not share personal, confidential, sensitive, client, employee, commercial, legal, financial, trade secret or third-party information in forms, emails, live sessions, group settings, chats, calls, surveys, community spaces or public participation features unless you are authorised and comfortable with that information being disclosed in that setting.
We may treat certain communications as confidential where expressly agreed in writing or where the context clearly requires reasonable confidentiality. However, confidentiality may be limited where required or authorised by law, where there is a serious risk of harm, where disclosure is necessary for professional, legal, administrative or technical support, or where disclosure is necessary to protect rights, safety, systems, participants or the public.
We do not seek to collect sensitive information unnecessarily. If you choose to provide sensitive information, you consent to us handling it in accordance with our Privacy Policy and for the purposes for which it was provided.
20. Live events, recordings and replays
The Services may include live online sessions, workshops, webinars, interviews, forums, meetings, streamed sessions, screenings, recordings, replays, group discussions, chat features, questions, comments, polls, surveys or other interactive elements.
We may record live online sessions or events. If you choose to appear on camera, speak, ask a question, post in chat, submit comments, respond to polls, participate in discussion, or otherwise contribute, your name, image, voice, comments, questions, poll responses or other participation may be captured in a recording or replay.
Replay access, recordings, slides, transcripts, notes, workbooks and post-event materials may not always be available. Where replays or materials are available, access may be subject to registration status, purchase status, access period, platform availability, technical limitations and any applicable terms.
You must not record, screenshot, copy, download, reproduce, publish, redistribute, livestream, transmit, sell, share or make available any live session, replay, recording, access link, slide, workbook, transcript, private communication or related resource without our prior written permission.
21. Community, comments and participant conduct
Some Services may include community features, comments, forums, chats, peer discussions, participant spaces, member spaces, public events, live discussions or group settings.
You must participate respectfully, honestly and lawfully. You must not harass, abuse, threaten, shame, defame, spam, impersonate, exploit, solicit, mislead, pressure, manipulate, record without permission, disclose private information, or otherwise interfere with other participants or the Services.
We may moderate, remove, hide, edit, restrict, preserve or decline submissions, comments, messages, chats, posts, profiles, questions or other contributions at our discretion.
We may remove a person from a community space, event, call, discussion, Program or Service if we reasonably believe their conduct is unlawful, abusive, unsafe, disruptive, misleading, inappropriate, unauthorised, confidentially risky, commercially exploitative or inconsistent with these Terms.
22. Acceptable use
You must not use the Website, Content, Publications, Digital Products, Network Websites, Programs, forms, platforms, community features, events or Services in any way that is unlawful, harmful, misleading, abusive, unauthorised or inconsistent with these Terms.
You must not:
- breach the privacy, intellectual property, contractual, moral, publicity, confidentiality, consumer, employment, data protection or other rights of any person;
- upload, transmit or distribute viruses, malware, worms, Trojan horses, spyware, malicious code or harmful material;
- attempt to gain unauthorised access to our systems, accounts, platforms, content, payment systems, forms, servers, databases, access pages or networks;
- interfere with, disrupt, damage, overload, scrape, crawl, copy, reverse engineer, probe, test, bypass or attempt to bypass the operation or security of the Website or Services;
- use our Content or Services to defame, harass, threaten, abuse, mislead, impersonate, shame, exploit, pressure, manipulate or unlawfully target any person;
- post or transmit material that is defamatory, obscene, pornographic, racist, discriminatory, threatening, abusive, unlawful, confidential without authority, commercially deceptive or otherwise inappropriate;
- share, sell, publish, transfer or misuse private access links, replay links, calendar links, login credentials, private access pages or restricted resources;
- use automated tools, bots, scrapers, crawlers, data-mining tools, artificial intelligence systems or other automated systems to collect, copy, analyse, train on, extract, monitor or reproduce Content without our prior written permission;
- use the Website, Content, Publications, Digital Products, frameworks, prompts, diagrams, program structures or Services for any commercial purpose not expressly authorised by us;
- create a competing, derivative, confusingly similar or substantially similar product, service, membership, course, scorecard, framework, publication series, rhythm, portal, community, counselling pathway or coaching program using our Content, structure, language, sequence or methods; or
- misrepresent your identity, affiliation, authority, organisation, intentions, relationship with us, results, qualifications or participation status.
23. Intellectual property
Unless otherwise indicated, we own or license all rights, title and interest, including copyright, trade marks, designs, moral rights, confidential information, trade secrets, know-how and other intellectual property rights, in the Website, Content, Publications, Programs, Digital Products, Network Websites, research materials, essays, articles, diagrams, frameworks, scorecards, videos, recordings, replays, workbooks, prompts, templates, planning methods, project materials, branding, design, software and Services.
Your use of the Website, Content, Publications, Digital Products, Network Websites, Programs or Services does not transfer any intellectual property rights to you.
Except as expressly permitted by these Terms, by law, or by our prior written permission, you must not copy, reproduce, download, distribute, publish, display, perform, communicate, modify, adapt, translate, create derivative works from, sell, license, exploit, reverse engineer, imitate, white-label, train from or commercially use any part of our Content, Publications, Digital Products, Programs, frameworks, scorecards, diagrams, recordings, replays, templates, prompts, writings, research materials, network materials or Services.
All rights not expressly granted are reserved.
24. No AI training, scraping or dataset creation
Unless we expressly authorise it in writing, you must not use the Website, Content, Publications, Digital Products, Network Websites, Programs, transcripts, recordings, replays, live sessions, prompts, templates, frameworks, diagrams, written materials, community materials, project materials or Services for artificial intelligence training, machine learning, model training, embeddings, dataset creation, scraping, crawling, automated extraction, summarisation at scale, benchmarking, synthetic data generation, prompt library creation, knowledge-base extraction or similar automated analysis.
You must not upload our private Content, paid Content, member Content, private sessions, replays, recordings, templates, prompts, worksheets, diagrams, scorecards, frameworks, transcripts, community posts or confidential materials into public or third-party artificial intelligence systems unless we have expressly authorised that use in writing.
This section does not prevent you from using ordinary personal note-taking tools for your own private use, provided you do not copy, distribute, train, publish, extract, commercialise, share or expose our Content in breach of these Terms.
25. Personal, educational and internal use
Unless we expressly agree otherwise in writing, the Website, Content, Publications, Digital Products and Services are provided for your own personal, private, educational, reflective and internal use only.
You may link to public pages of the Website in a fair and non-misleading way, provided you do not imply endorsement, reproduce substantial Content, frame our Website, misrepresent our work, or use our Content in a way that breaches these Terms.
You must not use our Content, Publications, Programs, recordings, replays, workbooks, prompts, exercises, scorecards, planning sequences, frameworks, live session materials, project materials or Services for advertising, commercial training, revenue generation, client delivery, paid events, organisational programs, institutional use, educational delivery, public performance, commercial promotion, consultancy delivery, coaching programs, mastermind programs, retreats, seminars, workshops or other commercial purposes without our prior written permission or a separate written agreement.
If you wish to use our materials with a team, staff group, organisation, client group, school, church, agency, consultancy, business, institution or other group, you must obtain our prior written permission or enter into an appropriate licence or group agreement.
26. Third-party platforms, services and links

33. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty, condition or liability that cannot lawfully be excluded, restricted or modified.

Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of resupplying the relevant service.

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be severed to the extent necessary, and the remaining parts will continue in full force and effect.

If we do not exercise or enforce a right under these Terms, that does not mean we waive that right.
